Terms of Service

Version: draft-2026-11 ยท Last updated: 1 November 2026

In short

These terms are the agreement between your organisation and HydroNote for using the service. You pay for a subscription, you own your data, you use HydroNote responsibly, and you stay responsible for your own compliance decisions.

1. Who we are

HydroNote is provided by [HydroNote Pty Ltd, ABN to be added] ("HydroNote", "we", "us"). "Customer" or "you" means the organisation that subscribes, and "Users" means people the Customer allows to use HydroNote.

2. The service

HydroNote is an online system for recording, checking and reporting water and wastewater operational data. We may improve or change features over time. We will give reasonable notice of changes that materially reduce the service.

3. Accounts and users

You are responsible for who you give access to, for keeping passwords private, and for your Users following these terms. Tell us promptly if you suspect unauthorised access.

4. Free trial

A free trial may be offered for 15 days, which we may extend on request. Trials are provided as is. At the end of a trial, data may be kept read-only for 30 days so you can export it, then deleted unless you subscribe.

5. Subscriptions, fees and add-ons

Fees are set out in your quote or order and are payable monthly or annually as agreed. Prices are in Australian dollars and exclude GST unless stated. Add-ons are charged separately as one-time fees unless your quote says otherwise. Invoices are payable within 30 days unless agreed otherwise.

6. Your data

You own all data you or your Users enter or import ("Customer Data"). You give us permission to store and process Customer Data only to provide and support the service. See the Data Ownership statement and Privacy Policy.

7. Our intellectual property

HydroNote software, design and documentation remain our property. You receive a non-exclusive, non-transferable right to use the service during your subscription.

8. Acceptable use

You must follow the Acceptable Use Policy.

9. Compliance responsibility

HydroNote helps you check data against the limits you set. You remain responsible for setting correct limits, for regulatory compliance, for notifications to regulators and health authorities, and for operational and public health decisions. See the Compliance Disclaimer.

10. Availability and support

We aim to meet the targets in the Service Level and Support statement. Planned maintenance will be scheduled outside business hours where practical.

11. Confidentiality

Each party will keep the other's confidential information confidential and use it only for this agreement.

12. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our total liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss, including loss arising from decisions made using data in HydroNote. [Lawyer to review.]

13. Suspension and termination

Either party may end the subscription at the end of a billing period with 30 days' notice. We may suspend access for unpaid fees after notice, or immediately to protect the service or other customers from harm.

14. Data on exit

You can export your data at any time. After termination, we keep Customer Data for 30 days so you can export it, then delete it, except where we must keep it by law.

15. General

These terms are governed by the laws of Victoria, Australia. We may update these terms with 30 days' notice; continued use after that means you accept the update. Contact: [contact email].
